1. Acceptance of Terms

By accessing or using Buttr (the “Service”), operated by Buttr, Inc., you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and Buttr, Inc..

2. Description of Service

Buttr provides an artificial-intelligence-powered support platform designed to help operators diagnose, troubleshoot, and resolve issues with Toast POS systems. The Service includes access to an AI chat engine, real-time Toast system status monitoring, hardware and software diagnostic tools, and tiered subscription features.

Buttr is an independent service and is not affiliated with, endorsed by, or a subsidiary of Toast, Inc. or any of its subsidiaries.

3. Accounts and Eligibility

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your credentials.
• You must provide accurate and complete registration information.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

Buttr offers free and paid subscription tiers. Paid plans are billed on a monthly or annual basis as described on our Pricing page. By subscribing to a paid plan, you authorize us (via Stripe) to charge your payment method on a recurring basis.

• Subscription fees are non-refundable except as required by law or as stated in our refund policy.
• We reserve the right to change pricing with 30 days’ notice.
• Failure to pay may result in suspension or termination of your account.
• Promotional pricing is subject to change and applies only for the stated promotion period.

5. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to:

• Using the Service for any unlawful purpose
• Attempting to reverse-engineer, scrape, or extract our AI model weights or proprietary data
• Sharing account credentials with unauthorized third parties
• Submitting false, misleading, or malicious content to the AI
• Exceeding rate limits or attempting to circumvent feature restrictions

6. AI Disclaimer

The AI diagnostic features of the Service are provided for informational and guidance purposes only. Buttr does not guarantee the accuracy, completeness, or suitability of any AI-generated response for a specific situation. Always exercise independent judgment when implementing any guidance. Buttr is not liable for any damage to Toast POS systems, hardware, data loss, or revenue loss arising from AI-generated recommendations.

7. Intellectual Property

All content, design, software, trademarks, and intellectual property within the Service are the exclusive property of Buttr, Inc. or its licensors. You may not copy, reproduce, distribute, or create derivative works without our express written consent. You retain ownership of any content you submit to the Service, but grant us a limited license to use it to provide and improve the Service.

8. Third-Party Services

The Service may integrate with or display data from third-party services including Toast, Stripe, Supabase, and others. We are not responsible for the content, availability, or practices of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Buttr, Inc. and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total cumulative liability shall not exceed the greater of $100 USD or the amount you paid to us in the three months preceding the claim.

10. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the account settings page. We may suspend or terminate your access immediately if you breach these Terms, with or without notice, at our sole discretion. Upon termination, your right to use the Service will cease immediately.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 14 days before taking effect. Continued use of the Service following notice of changes constitutes acceptance of the updated Terms.
